The matrimonial property regime is the set of rules regulating the financial interests of spouses. In our Almería office, we advise you on choosing, modifying, or liquidating the regime that best suits your circumstances.
1. Community Property (Sociedad de Gananciales): This is the most common regime. Earnings or profits obtained by either spouse become common property and will be divided equally upon dissolution. Private assets (inheritances, gifts, assets owned prior to marriage) are excluded.
2. Separation of Assets (Separación de Bienes): Each spouse retains the ownership and administration of their own assets. There are no common assets, except those they choose to acquire jointly. Ideal for couples with significantly unequal assets or for second marriages.
3. Participation Regime (Régimen de Participación): Each spouse maintains separate ownership of their assets, but upon dissolution of the marriage, the net gains obtained during the relationship are shared. It is a fair system for couples with very different incomes, as only the economic increase achieved by each is shared.
4. Marital Agreements (Capitulaciones Matrimoniales): Spouses can freely agree on their property regime, including a mixed or customized one, provided it does not violate fundamental rights. It is possible to combine elements of various regimes.
At any time during the marriage, provided both spouses agree and formalize it through marital agreements before a notary.
In most of Spain (common law territory), if nothing is agreed upon, the default regime applied is community property (sociedad de gananciales).
In community property, debts incurred for family needs are joint. In separation of assets, each spouse is liable with their own assets. In participation, the impact on net gains is analyzed.
